Can real estate agents work on Anzac Day?

 

In an effort to clarify whether or not real estate agents can operate at all on Anzac Day, we have today made contact with all of the relevant institutes, including New Zealand, and in some cases we’ve made contact with either the office of fair trading or the Agents Board to get final clarification.

Here is the bottom line:

Queensland – there is legislation exists preventing any transaction or any activity by agents on Anzac Day with the exception of any rental transactions.

Western Australia – no legislation however advice to members is that they should respect the day and in most cases no agencies will open.

Victoria –  there is legislation preventing shops opening before 1 PM but nothing exclusively devoted to real estate. Advice from the Institute is that no-one should operate before 1 PM.

New South Wales – similar to Victoria where there is legislation preventing shops opening before 1 PM but nothing exclusively devoted to real estate. Advice from the Institute is that no-one should operate before 1 PM.

South Australia – the Institute there has advised its members not to open in the morning.

Tasmania – we were not able to get a definitive answer however we believe it is similar to Victoria and advice would be not to operate at all until after 1 PM.

Northern Territory – the decision is left solely up to the individual as the are no restrictions and no advice from the Institute

New Zealand – the Institute there advises they are guided by the Ministry of Business and Labour which says on its website that “retailers and market operators in general cannot open in the morning on Anzac Day” however they are aware that some retailers will open in the morning and it’s hoped that they will reconsider.

It appears that by and large it is up to the individual with the exception of Queensland where it is illegal to open or operate. Advice from most institutes is that respect it should be shown and if there is an intention to trade shouldn’t occur until after 1 PM.

    I don’t think the question is can you do an open/ auction a house/ knock some doors/ phone some ‘leads’ on ANZAC Day – whether before 1pm or not, it’s …should you .

    That’s only up to the agent I guess, but I could think of a lot of smarter ways to have positioned yourself before and after rather than risking your reputation ‘selling’ well others are mourning.
