In this article, we\u2019ll delve deeper into what you need to know before exchanging sales contracts in New South Wales specifically.<\/p>\n<h3>The peculiarities of contract exchange in NSW<\/h3>\n<p>When buying or selling real estate in New South Wales, the Contract of Sale must come with a series of\u00a0<a href=\"http:\/\/propertyupdate.com.au\/prescribed-documents\/\" target=\"_blank\" rel=\"noopener noreferrer\">Schedule 1 Prescribed Documents<\/a>.<br \/>\nThese documents are prepared by the vendor\u2019s conveyancer\/solicitor to inform\u00a0the\u00a0potential buyer\u00a0of relevant information about the property.<br \/>\nA principal difference with Victoria is that the Section 32 document \u2013 which is a compulsory vendor statement \u2013 is prepared to enable the selling agent to market the property. Once the property sells, the Contract of Sale is attached to the Section 32 to complete the exchange.<br \/>\nIn NSW, on the other hand, a lawyer or solicitor will prepare the\u00a0<a href=\"http:\/\/intuitivefinance.com.au\/contract-sale-what-to-look-for\/\" target=\"_blank\" rel=\"noopener noreferrer\">Contract of Sale<\/a>\u00a0to enable the selling agent to market the property. Then, once the property sells, they insert the purchaser\u2019s details and price considerations into the contract.<br \/>\nAccording to the NSW Office of Fair Trading, the Contract of Sale must include a copy of the title documents, drainage diagram and a current zoning certificate (s149) issued by the local council.<br \/>\nAlso, if the property has a swimming pool or a spa, then various certification forms must also be attached. Exemptions may apply to this, for example if the property is a lot in a strata or community titles scheme, or has been purchased off-the-plan.<\/p>\n<h3>The NSW sales process<\/h3>\n<p style=\"text-align: center\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-13801 aligncenter\" src=\"https:\/\/i0.wp.com\/realestatetalk.com.au\/wp-content\/uploads\/2017\/09\/image-1-IF.jpg?resize=300%2C291\" alt=\"\" width=\"300\" height=\"291\" \/><\/p>\n<p>One of the more interesting elements of the buying and selling of property in New South Wales is that there are two copies of the sales contract \u2013 one for the vendor and one for the buyer.<br \/>\nRegardless of whether the property is being sold by private treaty or auction, the physical\u00a0<a href=\"http:\/\/www.fairtrading.nsw.gov.au\/ftw\/Tenants_and_home_owners\/Selling_property\/The_sale_process.page\" target=\"_blank\" rel=\"noopener noreferrer\">exchange of sale contracts in NSW<\/a>\u00a0is the critical legal part of the sales process.<br \/>\nEach party to the transaction signs one copy before the two are swapped or\u00a0\u201cexchanged\u201d. This process is usually facilitated by the legal representatives of both parties.<br \/>\nIn NSW, this exchange of contracts is subject to a number of legal considerations.\u00a0For example:<\/p>\n<ul>\n<li>Neither party is legally bound until the signed copies of the contract have been exchanged, which means that either party can simply walk away from negotiations before that point in time.<\/li>\n<li>Buyers of a property sold by private treaty generally have a five working day cooling-off period after exchanging contracts.<\/li>\n<li>However, this cooling-off period\u00a0does not apply to sellers, which means they are usually bound to complete the transaction.<\/li>\n<li>When it comes to cooling-off periods, these can be waived, rescued or extended by negotiation before contracts are exchanged.<\/li>\n<li>There is no cooling-off period when purchasing at auction.<\/li>\n<\/ul>\n<h3>Preparing and exchanging contracts as a seller<\/h3>\n<p><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-13802 aligncenter\" src=\"https:\/\/i0.wp.com\/realestatetalk.com.au\/wp-content\/uploads\/2017\/09\/image-2-IF.jpg?resize=1024%2C447\" alt=\"\" width=\"1024\" height=\"447\" \/><br \/>\nBuying or selling real estate requires adherence to a number of laws. This is why legal representatives rightly play a vital role in the process.<br \/>\nIn New South Wales, if selling property, you need to start the process by appointing a lawyer or solicitor to act on your behalf.<br \/>\nOnce you have done that, you would\u00a0instruct your representative to\u00a0<a href=\"http:\/\/www.clickconveyancing.com.au\/selling.html\" target=\"_blank\" rel=\"noopener noreferrer\">prepare a Contract of Sale<\/a>\u00a0for your property. By NSW law,\u00a0a residential property can\u2019t be offered for sale unless your sales agent also holds the proposed sales contract.<br \/>\nYour lawyer or conveyancer will also proceed with a number of other legal steps,\u00a0which include:<\/p>\n<ul>\n<li>Ordering any searches legally required to be included in the Contract of Sale.<\/li>\n<li>Answering queries about\u00a0the proposed sale of your property from prospective buyers or their legal representatives.<\/li>\n<li>During the negotiation process, they will also make any agreed amendments between the seller and the buyer to the contract before it is exchanged.<\/li>\n<\/ul>\n<p>Once negotiations are completed, contracts are\u00a0then exchanged between the seller and buyer.<br \/>\nThe formal contract exchange is\u00a0managed by legal representatives, and involves each party signing the final contract.<br \/>\nThe seller then notifies\u00a0their lender about the sale, and provides their bank with a signed discharge authority.<\/p>\n<h3>Preparing and exchanging contracts as a buyer<\/h3>\n<p>Buying property in New South Wales still requires the ability to negotiate, as well as an understanding of what you can afford to pay for a property.<br \/>\nTo begin the process, therefore, you should speak to a professional mortgage broker to understand your borrowing capacity, and to ensure that you\u2019re not trying to buy a property that you literally can\u2019t afford.<br \/>\nOnce you\u2019ve done that, as well as thoroughly researched the market, it\u2019s time to begin the search for your ideal property \u2013 whether it\u2019s going to be a home or an investment.<br \/>\nIn NSW, once you find a property, as a buyer you would then\u00a0<a href=\"http:\/\/www.clickconveyancing.com.au\/buying.html\" target=\"_blank\" rel=\"noopener noreferrer\">instruct the seller\u2019s agent to send a copy of the contract<\/a>\u00a0to your lawyer or conveyancer for review.<br \/>\nYour legal representative will\u00a0also act on your behalf during any negotiations, such as on price, or other conditions like the settlement date.<br \/>\nOnce negotiations are successfully completed, you then organise to pay the agreed deposit.<br \/>\nThe contract will be prepared by your lawyer for you to sign, and then sent to the seller\u2019s solicitor.<br \/>\nOnce the cooling-off period has passed, it\u2019s time for the final legal and financial requirements to be fulfilled before the property is all yours!<br \/>\n<em>Disclaimer:<\/em><br \/>\n<em>The information provided in this article is general in nature and does not constitute personal financial advice.
